IMPORTANT NOTICE REQUIRED BY TEXAS LAW

Pursuant to Texas Property Code § 53.255, the following notice is required for residential construction contracts over $5,000.00:

You and your contractor are responsible for meeting the terms and conditions of this contract. If you sign this contract, you will be obligated to pay the agreed contract price even if you are dissatisfied with the work. If you are dissatisfied with the workmanship, you should try to resolve the dispute with your contractor. There are legal remedies available if you cannot. If you do not pay the contract price, the contractor may be able to place a lien on your property. — Texas Property Code § 53.255

For any ground-penetrating work, including French drain installation, irrigation installation, or trenching:

Client represents that all private underground utilities, irrigation lines, drainage pipes, electrical conduits, and other subsurface improvements not covered by the Texas811 locate have been physically marked prior to commencement of work, pursuant to Texas Utilities Code Chapter 251. Better Call Sod LLC is not liable for damage to unmarked private improvements.


Chemical Application Notice

Chemical Application Notice

Required by 4 Tex. Admin. Code § 7.23 for any pesticide, herbicide, or fertilizer application.

This agreement includes chemical application services.

If checked, the following information will be provided at or before the time of application:

  • Product name and EPA registration number
  • Target pest or condition
  • Application rate
  • Re-entry interval
  • Applicator license number

Chemical application records will be maintained for a minimum of two (2) years pursuant to 4 Tex. Admin. Code § 7.24.

If Client cancels this agreement:

  • More than 72 hours before scheduled date AND before materials are ordered: Deposit refunded less actual costs incurred by Better Call Sod LLC
  • Within 72 hours of scheduled date OR after materials are ordered: Deposit is non-refundable
  • After work has commenced: Full contract price is due

Satisfaction Guarantee

Satisfaction Guarantee

Better Call Sod LLC stands behind the quality of our work. If Client is not satisfied with a completed service, Client must notify Better Call Sod LLC within 48 hours at info@bettercallsod.com or 940-222-5150. Better Call Sod LLC's obligation upon a valid complaint is to re-perform the unsatisfactory portion of the service. Refunds for completed services are at the sole discretion of Better Call Sod LLC.

Sod Installation Warranty: 30 days from installation date, subject to Client's compliance with all written post-installation care instructions and the warranty terms in Better Call Sod LLC's Terms of Service.


Lien Rights Notice

Lien Rights Notice

Pursuant to Texas Property Code Chapter 53, persons who provide labor or materials for improvements to your property may have lien rights against your property if they are not paid. Better Call Sod LLC reserves all rights under Texas Property Code Chapter 53, including the right to file a mechanic's and materialman's lien on the property described in this agreement in the event of non-payment.

Upon receipt of final payment, Better Call Sod LLC will provide a lien waiver releasing all lien rights for work covered by this agreement, pursuant to Texas Property Code § 53.084.


Incorporation of Terms

Incorporation of Terms of Service

This Service Agreement is subject to and incorporates by reference the Better Call Sod LLC Terms of Service available at bettercallsod.com/terms, including all provisions regarding dispute resolution, arbitration, limitation of liability, and governing law. In the event of any conflict between this Service Agreement and the Terms of Service, the Terms of Service shall control except as to the specific pricing, scope, and schedule set forth in this agreement.


Signatures

Electronic Signature and Acceptance

By signing below or by electronically accepting this agreement via the Better Call Sod LLC online portal, Client agrees to be bound by the terms of this Service Agreement and the Better Call Sod LLC Terms of Service. Electronic acceptance has the same legal effect as a handwritten signature pursuant to the Texas Uniform Electronic Transactions Act, Texas Business & Commerce Code Chapter 322.
